The relevant person in charge of the construction market supervision department of the Ministry of Commerce interpreted the relevant contents of the interim measures

according to the person in charge, for a long time, the field of housing and urban rural construction has actively explored and promoted the construction of the integrity system of the construction market, and achieved certain results, but there are still some prominent problems, such as insufficient disclosure and sharing of credit information among market players, prominent information islands, non-standard credit evaluation behavior, local barriers set up by credit management in some regions, etc. In order to solve these outstanding problems, the Ministry of housing and urban rural development launched the drafting of the interim measures, held document drafting forums for many times, and invited key personnel and industry experts in charge of the construction of the integrity system in some provinces and cities to put forward work suggestions on the credit management of the construction market, and solicited opinions from the whole country for many times

■ highlight 1: credit information disclosure bad credit information disclosure 6 months to 3 years in order to solve the problems of untimely and incomplete disclosure of credit information of market players, the interim measures clearly defines the definition of credit information, that is, credit information includes basic information, good credit information and bad credit information; Strengthened the collection and management of credit information, required to rely on the public service platform of construction market supervision to collect credit information in a centralized manner, and clarified the information collection, especially required to strengthen the verification of project information; It stipulates that credit information should be centrally disclosed through public service platforms, and defines the disclosure period, that is, basic information should be disclosed for a long time, good credit information should be generally disclosed for 3 years, and bad credit information should be generally disclosed for 6 months to 3 years

■ highlight 2: credit information sharing plays the role of public service platform for national construction market supervision. In order to further improve the credit records of market players, establish a mechanism for credit information collection and sharing, and give full play to the role of public service platform for national construction market supervision, The interim measures require all provincial housing and urban rural construction departments to push the good and bad credit information of market players to the national public service platform for construction market supervision. At the same time, we should strengthen contacts with relevant departments, promote the interconnection of credit information systems, and establish an information sharing mechanism

The competent departments of housing and urban rural development at all levels should make full use of the national public service platform for the supervision of the construction market to establish a mechanism for encouraging and punishing honesty, implement classified supervision of enterprises, implement incentive measures for those with good credit, and take disciplinary measures for those with serious dishonesty in accordance with the law. At the same time, it is stipulated that relevant units or individuals should use credit information in accordance with the law and should not use information beyond the disclosure period. In addition, the local competent departments of housing and urban rural development at all levels should also establish a mechanism for handling objections, appeals and reports of credit information, and timely make changes in credit information through the public service platform for construction market supervision

■ highlight 4: establish a system of "blacklisting our products to ensure after-sales service for a long time", which can be removed at the expiration of one year. The interim measures require the establishment of a "blacklist" system for construction market entities, and clarify the criteria and conditions for inclusion in the "blacklist" of construction market entities, which will be made public to the public through the construction market supervision public service platform. The management period of the "blacklist" of construction market entities is 1 year, and they can be removed from the list after the expiration of the period. For those listed in the "blacklist" of construction market entities, disciplinary measures should be taken, restrictions should be imposed on market access, qualification management, bidding and other aspects according to law, and other departments should be notified to implement joint punishment

■ highlight 5: standardize credit evaluation behavior and do not set local credit barriers. At present, most places have carried out credit evaluation, but some evaluation behaviors are not standardized, and even local protection is implemented through credit evaluation. In order to solve these problems, the interim measures specifically stipulates credit evaluation: first, clarify the subject of credit evaluation, that is, the competent department of housing and urban rural construction can carry out credit evaluation of the construction market, and encourage third-party institutions to carry out credit evaluation. Second, it stipulates the main contents of credit evaluation and the application scope of evaluation results, and requires that the credit evaluation methods, standards and results be made public on the provincial construction market supervision integration platform and accept social supervision. Third, in accordance with the principles of openness, fairness and impartiality, we should formulate credit evaluation standards, not discriminate against foreign enterprises or individuals, not set up credit barriers, and encourage construction units to evaluate the performance of contractors

■ highlight 6: strengthen supervision and inspection, regularly verify the poor implementation, and be notified that the interim measures require all provincial housing and urban rural construction departments to appoint special personnel or entrust special agencies to be responsible for the collection, release and push of credit information. The Ministry of housing and urban rural development will establish a spot check and notification system for the promotion of credit information in the construction market, regularly check the reporting of credit information by the provincial competent departments of housing and urban rural development, and notify the areas where the work is not implemented effectively. At the same time, the staff of the competent department of housing and urban rural construction are required to perform their duties strictly in accordance with the law
